Acceptance of Terms and Conditions

Please note that by registering as a Vendor and listing your products on go-mall.online, we assume that you have read, understood and agree with the Terms and Conditions of go-mall.online. Please read these terms and conditions carefully before using go-mall.online (digital online mall) (referred to as “Go-Mall”). By accessing or using the platform, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not use the platform.

Go-Mall is the storefront portion of Go-Ads, a digital marketing program. Go-mall is a multi-vendor environment, facilitating the showcasing, marketing and sale of products and services, by registered, approved and verified vendors.

Included in go-mall.online, is go-ads, which generates, creates, and publishes advertisements for the vendor with the information that has been provided by the vendor. Active marketing is done of the products and vendor, based on the information that the vendor has supplied when the products were uploaded.

Definitions

  1. “go-mall.online” (hereafter “Go-Mall”) is a digital mall that facilitates a digital storefront for vendors.
  2. “go-ads” is a digital marketing software that creates, and publishes advertisements on behalf of a vendor based on information provided by the Vendor.
  3. “Vendor” is any individual, business, organisation, or group that has registered to make use of the platform.
  4. “Channels” all the various destinations through which and where the advertisements of the Vendor are published.

Vendor Registration

  1. To access and use the platform, a Vendor is required to create an account. The Vendor agrees to provide accurate, complete, and up-to-date information during the registration process.
  2. The vendor will have to verify their email address.
  3. The Vendor will receive an email, to inform them whether they have been accepted or declined as a vendor for Go-Mall.

Platform Usage

  1. All Vendors will be verified, and approved before any of their products or services are listed. The approval can take up to 72 hours.  Vendors are also required to be a registered PayFast Merchant. The merchant ID must be provided to go-mall.online.
  2. Vendors are responsible to load their products for verification.
  3. The Vendor is responsible to provide accurate information and digital representations of the products and/or services that they want to be promoted. This information includes photos, descriptions, specifications, and/or warnings that are applicable.
  4. If you are accessing or using the platform on behalf of a company or organisation, you represent and warrant that you have the authority to bind that entity to these terms and conditions.  Proof of such authorisation might be required.

Product Listing Requirement

Products are marketed through various channels on various platforms. This means that products have to adhere to the respective requirements of the platforms used. Should a product not adhere to the requirements of a specific platform the advertisements for that specific product will not be placed on that platform, but on alternative platforms.

  1. Vendors that market or resell registered trademark products, must be able to provide documentation from a legitimate distributor or manufacturer should it be required.
  2. Vendors must have clear descriptions, which include the materials that were used, where possible.
  3. Clear pictures of the products from various angles have to be included.

Prohibited Products and Services

Unfortunately there are products and services that will not be allowed on Go-Mall. Below is a list of such products, but the list is not limited to these products and/or services.

  1. Live animals.
  2. Weapons that requires municians, license or registration.
  3. Any form of illegal drug.
  4. Any form of pornography.
  5. Adult entertainment, services or products.
  6. Plants that are protected or require a license.

Intellectual Property

  1. The platform and its contents, including but not limited to text, graphics, images, logos, trademarks, and software, are the intellectual property of the platform provider or its licensors. You may not copy, modify, distribute, sell, or lease any part of the platform without prior written consent.
  2. By using the platform, you grant the platform provider a non-exclusive, royalty-free, worldwide license to use, reproduce, share, distribute, and display any content that has been created by the platform for the purposes of providing the platform services.

Prohibited Conduct

  1. You agree not to use the platform for any unlawful or unauthorised purpose. You must comply with all applicable laws and regulations while using the platform. This includes but is not limited to offensive, misleading, or prohibited content, including hate speech, illegal products or services, or content that violates intellectual property rights.
  2. You may not engage in any activity that interferes with or disrupts the platform’s functionality, security, or availability.
  3. You may not upload, post, or transmit any content that is defamatory, obscene, infringing, or otherwise objectionable.
  4. You may not attempt to gain unauthorised access to any part of the platform, accounts, or networks connected to the platform.
  5. You may not use the platform for any form of unethical or deceptive advertising practices.

Services

  1. Go Mall through its digital marketing software, Go-Ads, digitally generates advertisements (which include videos) based on the information that the Vendor submitted digitally upon registration. This includes logos, branding, photos, descriptions, and any other material of products and/or services.
  2. These generated advertisements and videos will be published through various social media platforms, messaging platforms, and classified channels. These channels might be added to, or removed at the sole discretion of go-mall.online to ensure that the Vendor enjoys maximum exposure.

Fees

Vendors:

  1. Registration on Go-Mall is free.  However, to load products, receive exposure and utilise the platform do carry a fee.  This fee is commission based and consists of 3 components.  The first percentage being for the storefront of the vendor on the digital mall, the second percentage being for the active marketing and exposure, and the third percentage is for the secure payment gateway, Payfast.
  2. The percentage breakdown is as follow:

2.1 Storefront 10% (negotiable)

2.2 Active marketing 10% (negotiable)

2.3 Payment gateway: Payfast 5% (not negotiable)

  1. An additional fee can be charged if a Vendor is not able to maintain their inventory on the mall to a level that is required by law and to the benefit of customers.  

Customers

  1. The utilisation of the mall for customers is free.
  2. The cost of shipping of any product is for the account for the customer and is not included in the price of the products.

Returns and Refunds

  1. Customers must notify Go-Mall of their intention to return a product to a vendor and the reason for the return.
  2. After notifying Go-Mall the customer must then contact the vendor directly to return the product.  The client is responsible for shipping costs for the returning of the product.
  3. The vendor is responsible for the exchange or refund of the product to the customer.  The refund amount will be the price of the product, less any commissions paid to Go-Mall for services provided.
  4. Should the customer not be able to reach a satisfactory resolution with the vendor, the customer can lodge a complaint with Go-mall by sending an email to info@go-mall.online and clearly state the dispute.
  5. Go-Mall will endeavour to resolve the dispute. Should the dispute not be able to be resolved, Go-Mall reserves the right to appoint an external mediator/ ombudsman, or any other external independent person or entity to assist with the resolution of the matter.

Vendor Termination

  1. Vendors can be removed from the platform, if it is found that the vendor is engaged in misleading practices like delivering products different tot that advertised, without consulting the customer first and obtaining their approval.
  2. In the event that Go-Mall receives numerous complaints from customers with regards to a vendor, Go-Mall reserves the right to remove the vendor from the platform.
  3. Should a vendor be using the platform to market counterfeit products, or can not prove the legitimacy of the branded products that they sell, the vendor will be removed from the platform.  Go-Mall reserves the right to report such a vendor to the relevant authorities.


Limitation of Liability

  1. To the maximum extent permitted by law, the platform provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
  2. In no event shall the platform provider’s total liability to you for all claims arising out of or in connection with the use of the platform, exceed the amount you paid to the platform, if any, to use the platform.

Modification of Terms

  1. The platform provider reserves the right to modify these terms and conditions at any time without prior notice.  The updated terms will be effective upon posting on the platform.
  2. It is the responsibility of the customers and vendors to review the terms periodically to stay informed of any changes.

By using the platform, you acknowledge that you have read, understand, and agreed to these terms and conditions.
